Terms of Service

These terms govern your use of the GhostWhirl desktop application, website, and any related services. We’ve kept the language plain on purpose — if anything is unclear, email legal@ghostwhirl.com.

1. Acceptance

By installing, signing in to, or using GhostWhirl you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the service.

2. Your account

You must be at least 16 years old. Keep your login credentials confidential — anything done from your account is your responsibility. Tell us at security@ghostwhirl.com the moment you suspect unauthorised access.

3. Acceptable use

You agree not to use GhostWhirl to:

  • Break the law in your jurisdiction or anyone else’s.
  • Capture, transcribe or process meetings without the consent required by your local recording laws.
  • Impersonate another person, infringe intellectual property, or generate content designed to harass or defraud.
  • Interfere with our infrastructure — no automated scraping, no attempting to bypass rate limits, no probing for vulnerabilities outside our bug bounty programme.
  • Reverse-engineer or redistribute the desktop binary.

4. Subscriptions & billing

Paid plans are billed in advance through Stripe or Razorpay on a monthly or annual cycle. Subscriptions auto-renew at the same plan unless you cancel before the renewal date. Cancel any time from inside the GhostWhirl app (Settings → Billing) — your plan stays active until the end of the period you’ve already paid for.

Refunds: we issue a full refund within 14 days of the first charge if the product genuinely doesn’t work for you. After that, we don’t refund partial periods.

5. Your content

You own everything you put into GhostWhirl — meeting transcripts, notes, attachments, prompts. We get the limited licence needed to operate the product (store the data so you can read it back, route prompts to LLM providers so they can answer). We do not train models on your content and we do not sell it.

6. Our content

The GhostWhirl name, logo, app design, source code and documentation are owned by GhostWhirl Inc. and protected by copyright and trademark law. We grant you a non-exclusive, non-transferable licence to install and use the app in line with these terms.

7. Third-party services

GhostWhirl routes prompts to third-party model providers (OpenAI, Anthropic, xAI, Deepgram). Their terms govern how they handle requests once they leave GhostWhirl. We pick providers with zero-retention enterprise terms wherever possible — see our Subprocessors page for the full list.

8. Service availability

We aim for 99.9% monthly uptime on the cloud-side services that the app talks to (sync, billing, auth). The desktop app keeps working for local features — transcription, notes, screen-context — even when our services are down.

9. Disclaimers

GhostWhirl is provided “as is”. We don’t guarantee that AI answers are correct, complete, or appropriate for your situation. Treat them as suggestions and use your own judgement, especially in regulated, medical, legal or financial contexts.

10. Limitation of liability

To the maximum extent permitted by law, GhostWhirl Inc. is not liable for indirect, incidental, special or consequential damages, lost profits or lost data arising from your use of the service. Our total liability for any claim won’t exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

11. Termination

You can stop using GhostWhirl at any time and delete your account from the dashboard. We may suspend or terminate access for violations of these terms — we’ll give you reasonable notice unless the violation is severe enough to require immediate action.

12. Changes

Material changes to these terms are announced at least 30 days before they take effect. Continued use of the service after the effective date counts as acceptance.

13. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware.
